TERMS OF DOING BUSINESS & CONTRACTS
TIME LINE FOR COMMISSIONED WORK
The artist will consult with the prospective customer in the first phase of the project to determine the customer’s needs and requirements. The scope of the artist’s work and style are displayed on the artist’s portfolio and website; the customer will determine if the style of the artist’s work is what is desired to complete the project.
PROJECTED TIME SCHEDULE FOR EACH COMMISSION:
Phase 1 – Planning
2 hours initial interview and consultation
The artist will consult with the customer; determine the subject, medium, size and palette for the project.
Photographs and other reference material will be submitted/collected.
Agreement/Contract signed. Price, deposit required and date of completion will be agreed on. Advance payment will be due.
Phase 2 – Implementation
The artist will commence work on the project.
1 hour consultation (if needed) for pre-paint (drawing) and color check.
1 hour approval & modification – near the completion of the project and before clear coating, customer may view the work (if desired) for final approval.
Track Progress Online – The artist will create a space on his website for the customer to track the progress of the project.
Phase 3 – Completion
At the completion of the project, the balance owed on the contract is due. Art work will be transferred to the customer according to the terms of the contract.
The artwork must be picked up or delivery arranged within 30 days of notice of completion from the artist.
Delivery fee, shipping and handling fees are not included in the contract and are the responsibility of the customer.
TERMS OF CONTRACT
Interview and Consultation Hours – 4 hours scheduled (see time schedule above) for each project. Additional hours, if needed, will be charged at $100/hour and any fraction of an hour. Consultations for changes to the project after it has been started will also be charged at this rate.
Advance Payment – 50% of the total cost of the project and 100% materials fee must be paid in advance prior to commencement of work. Advance payment is non-refundable once the project enters Phase 2.
Deadlines – Both artist and customer will agree on a reasonable date of completion in good faith. The artist reserves the right to extend the completion date to allow for unexpected events in the creative process. The customer will be notified of the delay and a new date will be agreed upon.
Cancellation Policy – All sales are final and can only be cancelled when mutually agreed upon by both artist and customer in writing. Any undocumented or verbal agreements will not be considered as official cancellation.
REPRODUCTION RIGHTS RESERVED BY ARTIST – reproduction of any original, commissioned work by the artist is reserved. Customers wishing to reproduce the artwork must obtain the rights via registered or notarized document.
Transfer of ownership – notify the artist of all work that is resold or transferred in order to maintain provenance.

*The prices listed for portraits, Murals and Other Artwork are strictly estimates to give the customer a general starting point. There are several variables that will affect the price up or down.
**Material cost is not included. With each project the first two hour of consultation is included in the price. Additional hours of discussion/consultation thereafter will be an additional charge of $100 per hour. Pre-drawings or other work will not be performed prior to signing of the commission agreement and a deposit received. All copyrights are retained by the artist covering conceptual, creative and intellectual properties.

Artist reserves the right to refuse requests for changes or adjustments to completed commissioned work, dependent on the artistic integrity of the artwork. A free 4-hour consultation is included at the initial Agreement to Commission for the Artist and Customer to agree on details of the commissioned work. Thereafter, additional fee is charged ($20/hour) for additional consultation time to discuss changes in the terms for the commissioned work. Customer will pay the balance of the total price at the completion of the commission.
Non-commissioned artwork. Sale of existing artwork is final and non-refundable. Exchange for another artwork of lesser or equal value is allowed.
